State: North Carolina

Makes it a crime to threaten to inflict serious bodily harm upon or to kill a law enforcement officer, probation or parole officer, detention facility employee, or another person as retaliation against the officer for performing the officer’s official duties.

Authorizes the court to order the destruction of a firearm if the court determines it is in the best interest of public safety,authorizes a law enforcement agency to consign a seized or unclaimed firearm to a federally licensed firearm dealer for sale or to allow destruction of the firearm if it is unable to be sold.

Directs local law-enforcement agencies to increase the age requirement for traffic-control officers,requires the North Carolina Community College System to offer a traffic-control training course for those that would be appointed as a traffic-control officer.

Increases the scope and punishment of hate crimes,requires the State Bureau of Investigation to create and maintain a hate crimes statistics database,requires the North Carolina Justice Academy to develop and provide law enforcement officers with training on identifying, responding to, and reporting hate crimes,requires the conference of district attorneys of North Carolina to develop and provide training to prosecutors on how to prosecute hate crimes.

Restores law and order in the state by holding accountable any public official in this state, whether elected or appointed, for the consequences that occur directly or indirectly from the public official’s act of causing law enforcement officers to stand down in the face of violent criminal actions including murder, rioting, looting, physical assault, damage to public or private property, pulling down statues or other memorials or monuments, vandalism, arson, or any other criminal act.

Increases the punishment for the burning of commercial structures,amends the offense of arson or other unlawful burnings that result in injury to a firefighter, law enforcement officer, fire investigator, or emergency medical technician,authorizes the commissioner of insurance through the office of state fire marshal to investigate fires,requires criminal history record checks of applicants to fire departments.

Increases protections, training, and oversight for state and local law enforcement officers,requires use of the federal bureau of investigation’s record of arrest and prosecution background (Rap Back) system for law enforcement hiring purposes,expands the administrative office of the court’s court date reminder system,decriminalizes non-statutory criminal offenses and violations,increases the punishment for riot offenses,mandates misdemeanor first appearances when a defendant is in custody.

Requires cities and counties to remove personal information from websites maintained by counties and cities when requested by certain law enforcement personnel, prosecutors, and judicial officers and to clarify certain personnel records of law enforcement officers.

Increases protections, training, and oversight for state and local law enforcement officers,to require use of the federal bureau of investigation’s record of arrest and
Prosecution background (rap back) system for law enforcement hiring purposes,to expand the administrative office of the court’s court date reminder system,to decriminalize non-statutory criminal offenses and violations,to increase the punishment for riot offenses,to mandate misdemeanor first appearances when a defendant is in custody,and to mandate first appearances for all charges when a defendant is in custody to be held within forty-eight hours.”
