Relates to facial recognition technology,relates to authorization of use by local law-enforcement agencies and public institutions of higher education,allows a locality or a public institution of higher education to authorize a local law-enforcement agency or campus police department to purchase or deploy facial recognition technology, which is defined in the bill.

“(B) A law enforcement agency or law enforcement officer shall not, nor direct a third party to, install, activate, or use any biometric surveillance system, including, but not limited to, in connection with an officer’s camera or any information collected by an officer’s camera.

(C) No surveillance information secured in violation of this section may be offered or admitted as evidence in any trial, hearing, or proceedings of any kind in any court of competent jurisdiction. In addition to any evidentiary rulings, or other sanctions, penalties, or remedies provided by law, a person may bring an action for equitable or declaratory relief in a court of competent jurisdiction against a law enforcement agency that violates this section.”

Relates to fingerprints and photographs by police authorities,provides that all duly constituted police authorities having the power of arrest may take the fingerprints and photographs of any person found in contempt or in violation of the terms or conditions of a suspended sentence or probation for a felony offense,provides for a recommendation of the Virginia State Crime Commission.
