Allows, in an interview during an administrative investigation, an employer to ask a law enforcement officer only questions that are material and relevant to an alleged misconduct,prohibits intentionally misrepresenting that direct evidence of the officer’s misconduct exists when it doesn’t,allows an employer to establish that the alleged misconduct is part of a pattern or habit,allows a diagnosis of post-traumatic stress to be made only by a licensed psychiatrist or psychologist.

Provides that in the case of a law enforcement officer-involved death, the chief judge of the circuit court of the circuit in which the law enforcement officer-involved death occurred shall appoint a special prosecutor to review the report of the investigators assigned to investigate an officer-involved death and to prosecute the officer involved in the death, if the special prosecutor determines that there is a basis for the prosecution.

Amends the Police and Community Relations Improvement Act,provides that in the case of a law enforcement officer involved death, the chief judge of the circuit court of the circuit in which the law enforcement officer involved death occurred shall appoint a special prosecutor to review the report of the investigators assigned to investigate an officer involved death and to prosecute the officer involved in the death, if the special prosecutor determines that there is a basis for the prosecution.

Revises the definition of crime to include the use of excessive force by a law enforcement officer regardless of whether the officer is arrested or charged with commission of a crime or public offense. Prohibits the board from denying an application based upon the victim’ s involvement in the crime, upon the victim’s failure to cooperate, based solely on a police report or the lack thereof, or based upon whether the law enforcement officer was arrested or charged with a crime.
